1. Introduction

1.1 These terms and conditions (“Terms”) govern the registration, attendance, and participation in the Live Agents Training Course (“the Course”) organized by Hotzone Solutions (“Organizer”) at the Military Research Institute Vojenský výzkumný ústav, s. p. (Training Facility) in Czechia.

1.2 By registering for the Course, you (“Participant”) agree to be bound by these Terms.

2. Eligibility and Registration

2.1 Participants must be at least 20 years old and have the legal capacity to enter a binding contract.

2.2 Participants must complete the registration form and upload digital colored copy/scan of the following documents with accurate and complete information:

  • A copy of passport.
  • Medical clearance to work in Personal Protective Equipment.
  • A letter of recommendation/reference from Participant’s employer or supervisor endorsing the participation in the Course.

2.3 after reference check and security clearance The Organizer reserves the right to accept or reject any registration at its sole discretion.

3. Course Fee and Payment

3.1 Participants are required to pay the Course fee specified on the registration form.

3.2 Payment must be made in full before the 23 of May.

3.3 The fee includes the following:

  • Course materials.
  • Training.
  • Access to the Training Facility.
  • Onsite catering.
  • Visa invitation support if needed.
  • Personnel protective equipment including protective suit, gas mask, and protective gloves and over boots.
  • Transportation to the facility from the meeting point Hotel Selsky Dvur at 8:15 AM.
  • Daily onsite medical checks prior and after every entry.
  • Two (AChE) blood laboratory analysis.

4. Cancellation and Refund Policy

4.1 Participants may cancel their registration by providing written notice to the Organizer.

4.2 Cancellation requests received more than 30 days before the Course start date will be eligible for a full refund, less a processing fee of 10% of the paid amount.

4.3 Cancellation requests received less than 30 days before the Course start date will not be eligible for a refund. However, the Organizer will offer the Participant to use his paid fees in future Course session.

5. Intellectual Property

5.1 All materials provided during the Course are the intellectual property of the Organizer/ Training Facility or its licensors and may not be reproduced, distributed, or used for any other purpose without the Organizer’s prior written consent.

6. Confidentiality

6.1 Participants must keep any confidential information received during the Course confidential and not disclose it to any third party without the Organizer’s prior written consent.

7. Health and Safety

7.1 Participants must comply with all safety instructions and regulations provided by the Organizer and the Training Facility.

7.2 Participants must be daily clean-shaven to ensure proper use and fitting of protective gear during the Course.

7.3 Participants must be cleared by on-site medical staff daily before participating in the Course activities. Failure to obtain clearance may result in exclusion from that day’s activities.

7.4 The Organizer reserves the right to remove any Participant from the Course if they fail to comply with safety instructions or pose a risk to themselves or others.

8. Liability and Indemnification

8.1 Participants are responsible for their own personal safety and belongings during the Course.

8.2 The Organizer will not be liable for any personal injury, loss, or damage to property unless such injury, loss, or damage is directly caused by the Organizer’s negligence.

8.3 Participants agree to indemnify and hold harmless the Organizer and the Training Facility, thier employees, and agents from any claims, damages, or expenses arising out of their actions during the Course.

9. Governing Law and Jurisdiction

9.1 These Terms are governed by the laws of the Netherlands.

9.2 Any disputes arising from or related to these Terms, or the Course will be subject to the exclusive jurisdiction of the courts of the Netherlands.

10. Compliance with Training Facility Regulations

10.1 Participants must comply with the safety and security regulations of the Training Facility.

10.2 Photography is strictly prohibited during the Course and inside the Training Facility.

10.3 Personal objects, such as mobile phones, cameras, laptops, tablets, watches, jewelry, and any other personal belongings, are not allowed inside the contaminated area.

10.4 In the event a personal object becomes contaminated, it must undergo a decontamination process as per the Training Facility’s guidelines. The Organizer is not responsible and financially liable for any damage or loss resulting from the decontamination process.

10.5 Participants are required to attend a security and safety briefing prior to the commencement of the Course. Upon attending the briefing, participants must sign a document acknowledging their attendance and understanding of the safety and security protocols. Failure to attend the briefing or sign the document may result in exclusion from the entry till fulfilled.

11. Travel and Accommodation

11.1 The Participant is responsible for arranging their own travel and accommodation to and from the Course location or meeting point.

11.2 The Participant is solely responsible for obtaining any necessary visas or travel authorizations required for entry into Czechia.

11.3 The Organizer can provide the Participant with a visa invitation letter upon request, but the Organizer does not assume any responsibility for the Participant’s ability to obtain a visa or travel authorization.

11.4 The Organizer may provide recommendations or suggestions for accommodation options near the Course location, but the Participant is solely responsible for making their own reservations and ensuring their accommodation meets their needs and preferences.

12. Consent for Use of Images and Recordings

12.1 By participating in the Course, the Participant grants the Organizer the right to take photographs, video recordings, or audio recordings of them during the Course activities.

12.2 The Participant acknowledges and agrees that any photographs, video recordings, or audio recordings taken by the Organizer during the Course are the sole property of the Organizer.

12.3 The Participant consents to the Organizer using their likeness, image, voice, and/or appearance as captured in photographs, video recordings, or audio recordings for promotional, educational, or other purposes deemed appropriate by the Organizer, without any compensation or prior approval. This consent includes, but is not limited to, the right to edit, use, and reuse said products for any and all purposes, including reproduction, disclosure, transmission, publication, broadcast, and posting on the Organizer’s website, social media platforms, and other promotional materials.

12.4 If the Participant does not agree with the use of their likeness, image, voice, and/or appearance in the manner described above, they must inform the Organizer in writing prior to the commencement of the Course. In such cases, the Organizer will make reasonable efforts to respect the Participant’s request, while still maintaining the ability to document the Course for internal purposes.

13. Force Majeure

13.1 Neither the Participant, the Training Facility nor the Organizer shall be held liable for any delay, interruption, or failure in the performance of their obligations under these Terms if such delay, interruption, or failure is caused by a force majeure event. For the purposes of these Terms, a force majeure event includes, but is not limited to, acts of God, war, terrorism, civil unrest, strikes or other industrial action, fire, flood, natural disasters, epidemics, pandemics, or any other event beyond the reasonable control of the affected party.

13.2 In the event of a force majeure event, the affected party shall promptly notify the other party in writing and shall make reasonable efforts to mitigate the impact of the force majeure event and resume performance of their obligations as soon as practicable.

13.3 If the force majeure event prevents, restricts, or delays the Course for a period of more than 30 days, either party may terminate their participation in the Course by providing written notice to the other party. In such cases, the Organizer shall refund any fees paid by the Participant, less any non-refundable expenses incurred by the Organizer in connection with the Course.

14. Marketing and Communication

14.1 By signing these Terms and Conditions, Participant agree to receive marketing and communication from the Organizer related to future events and services.

14.2 The Organizer may contact Participant via email or other means of communication provided during the registration process.

14.3 The Organizer may use Participant’ personal data, such as their name and contact details, for the purpose of marketing and communication.

15.4 Participant may opt-out of receiving marketing and communication from the Organizer at any time by contacting the Organizer in writing or clicking on the unsubscribe link provided in the communication.

14.5 The Organizer will take reasonable measures to ensure that any marketing and communication sent to Participant is relevant and of interest to them.

14.6 The Organizer will not share Participant’ personal data with third parties for marketing purposes without their prior consent.

14.7 Participant’ personal data will be stored securely and in compliance with applicable data protection laws.

14.8 By signing these Terms and Conditions, Participant agree to be included in the Organizer’s internal database for the purpose of future marketing and communication.

14.9 The Organizer may use third-party platforms, such as email marketing platforms. retargeting platforms, and social media, to send marketing and communication to Participant.

14.10 The Organizer will ensure that any third-party platform used to send marketing and communication to Participant is compliant with applicable data protection laws and has appropriate safeguards in place to protect personal data.

14.11 Participant are encouraged to review the privacy policies and terms and conditions of any third-party platform used by the Organizer.

14.12 Participant may opt-out of receiving marketing and communication from the Organizer via third-party platforms by following the opt-out instructions provided by the platform.

15. Data Privacy (EU GDPR)

15.1 The Organizer is committed to protecting the privacy and personal data of the Participants in accordance with the European Union General Data Protection Regulation (EU GDPR).

15.2 The Organizer will collect personal data from Participants during the registration process, which may include but is not limited to, name, contact details, occupation, and organization.

15.3 The Organizer will process personal data lawfully, fairly, and transparently, solely for the purpose of organizing and administering the Course, including communicating with Participants, providing access to course materials, and facilitating the Course activities.

15.4 The Organizer will not share personal data with third parties except where required by law or where necessary for the purposes of organizing and administering the Course. In such cases, the Organizer will ensure that appropriate data protection measures are in place to protect the personal data.

15.5 The Organizer will take appropriate technical and organizational measures to safeguard personal data, including secure storage and access controls.

15.6 The Organizer will retain personal data for no longer than is necessary to fulfill the purposes for which it was collected, or as required by law.

15.7 Participants have the right to request, rectify, or delete their personal data held by the Organizer. Participants may also request that the Organizer restrict the processing of their personal data or object to the processing of their personal data for legitimate reasons.

15.8 Participants may exercise their rights by contacting the Organizer in writing. The Organizer will respond to such requests in accordance with the EU GDPR.

15.9 By registering for the Course, Participants consent to the collection, use, and processing of their personal data as described in this Section 14 in accordance with the EU GDPR.

16. Insurance

16.1 Participants are recommended to have personal travel, health, and liability insurance coverage. The Organizer is not responsible for providing insurance coverage and is not liable in any case for any incidents or issues arising from the lack of insurance coverage.

17. Miscellaneous

17.1 The Organizer reserves the right to change the Course content, schedule, or location at its discretion.

17.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3 The Organizer’s failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

17.4 These Terms, together with the registration form, constitute the entire agreement between the Participant and the Organizer with respect to the Course and supersede any prior agreements, understandings, or representations, whether oral or written.

17.5 Participants may not assign or transfer their registration or any of their rights and obligations under these Terms without the Organizer’s prior written consent.

10.6 Any notices or other communication required or permitted under these Terms must be in writing and delivered by email or registered mail to the Organizer’s designated contact.

18. Amendments

18.1 The Organizer reserves the right to modify these Terms and Conditions as needed. Any changes will be communicated to Participants in a timely manner. Participants are responsible for reviewing any updates to the Terms and Conditions and for abiding by the updated terms during their participation in the Course.
